Sunday Retreats – Terms & Conditions
By booking and participating in any retreat hosted by Sunday Retreats (“the Company,” “we,” “us,” or “our”), you (“the Client,” “Participant,” or “you”) agree to the following Terms & Conditions.
By booking and participating in any retreat hosted by 779047 N.B. Ltd., operating as Sunday Retreats (“Sunday Retreats”), the participant (“you”) acknowledges that you have read, understood, and voluntarily agree to the following terms and conditions (the “Terms & Conditions”) for the booked retreat (the “Retreat”):
1. Booking, Deposit & Payment Terms:
a. A non-refundable deposit of $500 CAD is required to reserve your space on the Retreat.
b. Your registration is not considered complete until the deposit is received and all required registration forms are submitted.
c. The remaining balance must be paid in full no later than March 16, 2027 (60 days prior to the Retreat start date), unless you are enrolled in an approved payment plan established by February 14, 2027.
d. If your booking is within 90 days of the Retreat start date, you will be required to pay the full balance at the time of booking.
e. Accepted payment methods include e-transfer or payment through the online booking link.
f. All prices are listed in CAD unless otherwise stated.
2. Refund & Cancellation Policy (Participant-Initiated):
a. The deposit is non-refundable and non-transferable, except at the sole discretion of Sunday Retreats or where a refund is required by applicable law.
b. Any additional payments beyond the deposit are refundable until February 14, 2027, minus any third-party payment processing fees actually incurred by Sunday Retreats, except where a different refund right is required by applicable law.
c. No refunds will be issued after February 14, 2027. In exceptional circumstances, Sunday Retreats may consider refund requests on a case-by-case basis.
d. All cancellation requests must be submitted in writing via e-mail to Sunday Retreats.
e. This policy supports the quality, integrity and financial viability of the Retreat.
3. Cancellation of Retreat by Sunday Retreats: Sunday Retreats reserves the right to cancel the Retreat for any reason, including but not limited to insufficient enrollment, safety concerns or circumstances beyond the control of Sunday Retreats. If the Retreat is canceled by Sunday Retreats or cancellation occurs due to force majeure or circumstances beyond the control of Sunday Retreats, you will receive a full refund of all payments made, including the deposit, or may choose to apply your payment as a credit toward a future retreat within one calendar year (subject to availability; if the future retreat is priced higher, you are responsible for paying the difference), but Sunday Retreats is not responsible for your incidental expenses (including flights, visas, accommodations, or insurance), except to the extent required by applicable law or caused by Sunday Retreats’ own negligence, wilful misconduct, breach of applicable law, or non-waivable obligations.
4. Retreat Inclusions & Exclusions:
a. Retreat inclusions: Accommodation, Meals, Yoga classes, Surf lessons.
b. Retreat exclusions: Flights, Insurance, Visas, Transfers.
c. You are advised not to book flights until written confirmation of Retreat booking has been received from Sunday Retreats.
d. Sunday Retreats is not responsible for flight costs, delays, cancellations, missed connections or airline changes.
e. Airport transfers will be provided only if expressly listed in the Retreat inclusions; otherwise, you are responsible for arranging and paying for your own transfers.
5. Travel & Health Insurance: You are required to obtain and maintain, at your own cost, comprehensive travel and health insurance appropriate for the Retreat and your personal circumstances. Coverage should include: (a) trip cancellation and interruption, (b) flight delays or cancellations, (c) medical emergencies, (d) emergency evacuation and repatriation, (e) loss or damage to personal belongings, and (f) coverage for surfing, hiking, breathwork, movement, travel, wellness and any other activities in which you may participate. You are responsible for reviewing policy terms, exclusions, and coverage limits and for ensuring that insurance is in place at the time of booking. Travel insurance is the primary way to protect your financial investment should you be unable to attend or complete the Retreat.
6. Travel Documents & Visa Requirements: You are solely responsible for: (a) holding a valid passport (valid for at least six months beyond return date), (b) obtaining all required visas, permits, and entry documentation, and (c) meeting all health and entry requirements for the destination or destinations of the Retreat. Sunday Retreats is not responsible for denied entry or travel disruptions due to documentation issues, except to the extent caused by Sunday Retreats’ own negligence, wilful misconduct, breach of applicable law, or non-waivable obligations.
7. Health, Fitness & Medical Disclaimer: Retreat activities may include movement, breathwork, surfing, hiking, travel, wellness activities and other experiential modalities. Sunday Retreats is not a medical provider and nothing offered constitutes medical, psychological or therapeutic advice. Participation is not a substitute for professional medical or mental health care. You are responsible for ensuring you are physically, emotionally and mentally fit to participate. You agree to disclose any relevant medical conditions, injuries or limitations prior to the Retreat and to consult a qualified health professional before participating if you have any concerns.
8. Assumption of Risk; Separate Activity Waiver: You acknowledge that travel and Retreat participation involve inherent risks, including but not limited to physical exertion, changing weather and environmental conditions, ocean and water conditions, terrain, transportation, wellness and breathwork practices, movement, surfing, hiking, and third-party services. As a condition of participating in surfing, hiking, breathwork, movement, travel, wellness or other Retreat activities, you may be required to review and sign a separate activity waiver and release in a form provided by Sunday Retreats or the applicable activity provider. These Terms & Conditions do not limit any non-waivable rights you may have under applicable law.By participating, you:
a. Voluntarily assume all risks associated with the Retreat.
b. Release Sunday Retreats, its owners, staff, contractors and affiliates from liability for injury, loss or damage arising from participation in the Retreat, to the fullest extent permitted by law, except for liability arising from Sunday Retreats’ own negligence, gross negligence, wilful misconduct, breach of applicable law or non-waivable obligations.
c. Agree that participation is at your own risk.
d. Agree that Sunday Retreats’ total aggregate liability under these Terms & Conditions, whether in contract, tort or otherwise, shall not exceed the total amount paid by you for the Retreat, and in no event shall Sunday Retreats be liable for any indirect, incidental, consequential, special, or punitive damages, except to the extent such limitation is prohibited by applicable law, including for non-excludable liability, mandatory statutory rights or non-waivable consumer protection rights.
9. Suppliers & Independent Contractors: Some Retreat services may be provided by independent third-party contractors (e.g., drivers, guides, local facilitators).Sunday Retreats selects partners with care and is not responsible for the independent actions, omissions or performance of third-party providers, except to the extent liability arises from Sunday Retreats’ own negligence, wilful misconduct, breach of applicable law or non-waivable obligations.
10. Conduct, Safety & Removal: You are expected to: (a) respect group agreements, local customs and safety guidelines, and (b) behave in a manner that supports group safety and cohesion. Sunday Retreats reserves the right, in its reasonable judgment, to remove any participant who poses a risk to themselves or others, or whose conduct materially disrupts the Retreat. No refund will be issued in such cases, except where required by applicable law.
11. Photos, Video & Content Use: By attending the Retreat, you grant Sunday Retreats a perpetual, worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, edit, adapt, and publish photos or videos taken during the retreat in any media or format, whether now known or hereafter developed, for promotional, marketing, and educational purposes, including on social media, unless you submit a written opt-out request prior to the Retreat.
12. Retreat Itinerary Changes: Sunday Retreats reserves the right to modify the Retreat itinerary due to weather, safety considerations, availability changes or unforeseen circumstances. No refunds will be issued for reasonable itinerary adjustments, except where required by applicable law.
13. Communication: Primary Retreat communication will take place via email and a WhatsApp group.The official WhatsApp group will be created on or around February 14, 2027.Participants are responsible for monitoring these communication channels for important updates.
14. Payment Plan Default: If a Participant selects a payment plan:
a. All scheduled payments must be made on time according to the agreed payment schedule.
b. If a scheduled payment is not received by its due date, Sunday Retreats will provide written notice of the missed payment by email and a 7-day cure period to bring the account current.
c. If the missed payment is not cured within 7 days after notice, Sunday Retreats reserves the right to: (i) charge a late fee of $50 CAD per missed payment, where permitted by applicable law, (ii) revoke your Retreat space, and (iii) retain payments made to date, up to the amount of Sunday Retreats’ actual costs and losses arising from the default, as liquidated damages and not as a penalty, subject to applicable law and any non-waivable refund rights.
d. If you default on your payment plan after March 16, 2027 and fail to cure the default within the applicable cure period, all payments made are non-refundable, except where required by applicable law or to the extent they exceed Sunday Retreats’ actual costs and losses arising from the default.e. Participation in the Retreat is contingent upon the account being paid in full by March 16, 2027 (60 days prior to the Retreat start date), unless Sunday Retreats agrees otherwise in writing or applicable law requires otherwise. Sunday Retreats is not responsible for reminders beyond the written notice and any other reminders reasonably provided. You remain fully responsible for completing all payments on time.
15. Double or Triple Occupancy & Roommate Responsibility: If you select a double or triple occupancy room, you acknowledge and agree to the following:
a. If registering with a chosen roommate, both participants are individually responsible for their own payments and conduct.
b. If your roommate cancels, defaults, or is removed from the Retreat for any reason, Sunday Retreats will notify you in writing and you must elect one of the following within 7 days of receiving notice: (i) to pay the applicable single-room upgrade fee, or (ii) to accept reassignment to a new roommate, if available. If you fail to make an election within 7 days, Sunday Retreats may assign you a new roommate or apply the single-room upgrade fee at its discretion.
c. Sunday Retreats will make reasonable efforts to support roommate matching but cannot guarantee compatibility.
d. Refunds will not be issued due to roommate dissatisfaction or changes. This policy protects the shared room structure and overall Retreat logistics.
16. Consumer Rights: Nothing in these Terms & Conditions is intended to exclude, restrict or modify any mandatory statutory rights, consumer protection rights or other non-waivable rights or remedies that apply. If any provision of these Terms & Conditions conflicts with applicable mandatory law, the provision will apply only to the maximum extent permitted by law and the applicable mandatory law will prevail to the extent of the conflict.
17. Severability: If any provision of these Terms & Conditions is found unenforceable, the remaining provisions shall remain valid and enforceable, and the unenforceable provision shall be interpreted or modified to the minimum extent necessary to make it enforceable while preserving its intended effect as closely as permitted by law.
18. Governing Law: These Terms & Conditions shall be governed by and construed in accordance with the laws of New Brunswick, Canada. The parties irrevocably submit to the exclusive jurisdiction of the courts of New Brunswick for any dispute arising out of or in connection with these Terms & Conditions, unless otherwise required by applicable law.
19. Updates to Terms: Sunday Retreats reserves the right to update these Terms & Conditions from time to time. Any updates will apply to bookings made after the date of the update. The version in effect at the time of your booking will continue to govern your booking.
